Terms of Service — MyQueue

Operator: PiHub Systems (“we”, “us”) offers MyQueue, an online queue management service (“Service”).
Territory: The Service is offered in India only. By using the Service, you confirm you are doing so from India and for use at Indian premises unless we agree otherwise in writing.

1. Agreement
These Terms, together with the Privacy Policy and (for business customers) the Data Processing Addendum, govern use of the Service. If you do not agree, do not use the Service.
2. Who may use the Service
- Venue / business customer: A clinic, doctor’s office, or other organization that registers a venue and is responsible for staff and visitor interactions.
- Authorized users: Owners (e.g. Google sign-in where enabled) and staff using a staff key are responsible for safeguarding credentials.
- Visitors use check-in interfaces as guests of the venue; their use is also subject to notices the venue provides at the premises.
3. Trial — 90 days
Where the product offers a trial, each new registered venue may receive a ninety (90) calendar day trial beginning from the venue’s registration (or as stated in-product). Trial details, limits, and what happens after expiry (e.g. restriction of check-in/staff actions until subscription is active) are shown in the application and may be updated with notice to the owner email.
Email is our standard channel for account, billing, and important product notices.
4. Subscriptions and payment
Paid use is billed through Razorpay (or as displayed in-product). Fees, taxes (e.g. GST as applicable), renewal, failed payment, and cancellation are governed by checkout terms and Razorpay’s policies. Non-payment may result in suspension of queue features as implemented in the Service.
5. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of TRAI, spam, or telemarketing rules.
- Misrepresent identity, abuse staff keys, or attempt to access other venues’ data.
- Store clinical records or special-category health data in fields meant for queue administration.
- Reverse engineer or probe the Service in a way that harms security or availability.
- Send non-queue marketing using MyQueue messaging integrations without lawful basis and provider compliance.
6. Customer responsibilities (venues)
Venues are responsible for:
- Lawful collection of visitor information (including consent where required for SMS/WhatsApp).
- DLT / template registration for SMS and WhatsApp template approval with Meta or their BSP.
- Signage and truthful notices to visitors about queuing and alerts.
- Staff training and physical security of devices showing the queue.
- Accuracy of information entered into the Service.
7. Data protection
Processing of personal data is described in the Privacy Policy. When a venue instructs us to process visitor data to run the queue, the Data Processing Addendum applies. Subprocessors are listed at /legal/subprocessors.
8. Availability and changes
We strive for reliability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice where practicable—especially for material changes affecting paying customers (email).
9. Intellectual property
The Service, branding, and software are owned by PiHub Systems or licensors. You retain your own data and marks. We receive a limited license to host and process your data to provide the Service.
10. Disclaimer of warranties
The Service is provided “as is” to the fullest extent permitted by law. We disclaim implied warranties where allowed.
11. Limitation of liability
To the fullest extent permitted by Indian law, PiHub Systems’ total liability arising from these Terms or the Service is limited to the fees paid by you to PiHub Systems for the Service in the three (3) months before the claim (or INR zero during a free-only period), except where liability cannot be excluded (e.g. death or personal injury caused by negligence, fraud, or other non-waivable rights).
12. Indemnity
You will defend and indemnify PiHub Systems against third-party claims arising from your misuse of the Service, your messaging/compliance failures, or your breach of these Terms, subject to applicable law.
13. Suspension and termination
We may suspend access for risk, abuse, or legal reasons. You may stop using the Service at any time. Export or deletion of data may be subject to retention periods described under /legal/data-retention and technical capabilities.
14. Governing law and disputes
These Terms are governed by the laws of India. Courts at Patna, Bihar shall have exclusive jurisdiction, subject to mandatory provisions.
15. Miscellaneous
Assignment: You may not assign these Terms without our consent; we may assign to an affiliate or acquirer.
Entire agreement: These Terms and linked policies constitute the agreement regarding the Service.
Severability: If a clause is invalid, the remainder remains effective.
